Rep. Bobby Scott (D-Va.) asks about SERE. Did Yoo ever get information on SERE ahead of his August 1, 2002 memo? “The Justice Dept. has asked me not to answer that question. … I believe the privileges would be both attorney-client privilege and the protection of classified information.” Nadler points out that Steve Bradbury, the current head of the Office of Legal Counsel, admitted that the CIA interrogation program came from SERE!
Yoo’s lawyer whispers in his ear. “I recognize it’s your view that attorney-client privilege does not apply,” he says finally. “Those are the instructions I received. I don’t want to be in the middle of a privilege fight.”
Nadler: but the guy giving you these instructions answered the question! Blank stare.
Addington: “No, I didn’t discuss [SERE], but I have no reason to dispute Mr. Bradbury’s statement.”
